LAW OF HEALTH EXAMINATION AND TREATMENT

Pursuant to Constitution of the Socialist Republic of Vietnam;

The National Assembly promulgates the Law on Medical Examination and Treatment.

Chapter I

GENERAL PROVISIONS

Article 1. Scope

This Law prescribes the rights and obligations of patients; medical examination and treatment practitioners; medical examination and treatment establishments; technical expertise in medical examination and treatment; medical examination and treatment by traditional medicine and combining traditional medicine with modern medicine; medical examination and treatment humanely, not for profit; transfer of professional techniques in medical examination and treatment; apply new techniques, new methods and clinical trials; technical errors; conditions to ensure medical examination and treatment activities; mobilize and mobilize resources for medical examination and treatment in case of natural disasters, disasters, group A infectious diseases or emergency situations.

Article 2. Interpretation of terms

In this Law, the following terms are construed as follows:

1. Medical examination is the practice of medical examination and treatment practitioners using professional knowledge, methods and techniques to assess the patient’s health status, health risks and health care needs. .

2. Treatment is the practice of medical examination and treatment practitioners using professional knowledge, methods and techniques to solve a disease condition, prevent the occurrence and progression of a disease or meet the needs of care. patient’s health on the basis of medical examination results.

3. Patients are users of medical examination and treatment services.

4. “Medical examination and treatment practitioner” means a person who has been granted a license to practice medical examination and treatment by a competent Vietnamese agency (hereinafter referred to as the practitioner).

5.  Medical examination and treatment practice license  means a document issued by a competent Vietnamese authority to a person fully qualified to practice medical examination and treatment in accordance with this Law (hereinafter referred to as a license). work).

6. “Medical examination and treatment establishment” means an establishment that has been granted a license for medical examination and treatment by a competent Vietnamese agency to provide medical examination and treatment services.

7.  Licensing for medical examination and treatment activities  means a document issued by a competent Vietnamese authority to an establishment that fully meets the conditions for medical examination and treatment in accordance with this Law (hereinafter referred to as the certificate of medical examination and treatment). permission to operate).

8. Heirloom medicine or heirloom treatment method is a remedy or method of treatment based on experience handed down by a clan or family and effective treatment for one or a number of diseases prescribed by a specialized agency. on health recognized by the People’s Committee of the province.

9.  The person who has the traditional medicine or has the traditional method of treatment  is the person who holds the right to own the medicine or the treatment method specified in Clause 8 of this Article.

10. Patient without relatives is a person in one of the following cases:

a) The patient is in a state of emergency without identification, does not have relatives to accompany, does not have information to contact his relatives;

b) The patient at the time of entering the medical examination and treatment establishment cannot or has difficulties in cognition, behavior control and has no identification papers, no relatives to accompany, no information to contact. contact with relatives;

c) The patient’s identity has been identified but at the time of entering the medical examination and treatment establishment, he cannot or has difficulties in cognition and behavior control, has no family members to accompany him, and has no information to contact. contact with relatives;

d) Children under 6 months old are abandoned at medical examination and treatment establishments.
